Mark Rothman specialises in resolving disputes. In particular, he is an experienced provider of mediation to help individuals, families and businesses resolve Will Disputes, Civil and Commercial Disputes and Workplace Disputes.
Resolution by mediation is often a more attractive alternative to having disputes decided by a Judge, or not settling them at all.
Mark Rothman’s goal is to help solve problems and enable people, families and businesses to move on with their lives and focus on the future. . We are flexible in the way we work; allowing you to resolve matters in a way that suits your specific needs.
What is Mediation?
Mediation is a means of resolving disputes at any stage.
It takes place on a day agreed by the parties, at a convenient location (or by video conferencing).
Each party will have their own private space, and the mediator will speak to each party to get a better understanding of the issues and aims, so that he can understand where possible grounds for resolution may be, If the mediator feels it is suitable, he may get the parties, or their lawyers, to discuss matters directly with each other in a joint meeting, but this is not essential and no party is forced to have such a meeting.
Throughout the course of the day the Mediators will aim to bring the parties closer to an agreed resolution, and if an agreement is reached it will be put into writing so that it forms a legally binding agreement and puts an end to the ongoing dispute.
The process allows the parties to remain in control of the possibilities of settlement. No one will tell them if, or how they should resolve matters – that absolutely remains within their control.

Mark Rothman has spent his whole career in Dispute Resolution, initially as a Solicitor rising to lead Dispute Resolution / Litigation Departments, and for the past decade as a Mediator.
Mark Rothman therefore has experience in all aspects of Legal Disputes and brings this knowledge, and his desire to help those faced with a dispute, to his mediations.
Frequently asked questions
There are a number of questions we are often asked regarding our services. Should you have a question that is not listed below, please do not hesitate to get in touch.

Mediations are usually booked for half a day (typically 10am-1pm) or a full day (typically 10am-5pm). If the Mediation is progressing as the end time approaches the parties can agree to continue beyond that time. We would therefore always suggest that additional time is allowed for.

The individuals involved in the dispute, or a representative authorised to make decisions on behalf of a business involved, should attend as, ultimately, it will be they who will need to sign any agreement reached to make it binding. Others with knowledge of the dispute, or someone who can bring some support or company can also attend. However, it should be agreed prior to the mediation who will be attending for each party so everyone is well aware of who will be there on the day.

This is entirely up to you. Mark Rothman’s flexible approach means he is not prescriptive as to what you need to provide. It would be helpful to send any documents you think would be helpful for Mark to understand the dispute better, or that you would want to use to demonstrate particular points you would want to make at mediation.
Mark will read all documents you send him in advance of the Mediation.

Mediation can take place anywhere. Ordinary it will be at a neutral venue or at a venue provided by either party. We can provide high class mediation venues for you around the country.
Alternatively, Mediations can take place remotely using video conference. Mark’s preference is Zoom but is equally at home with the other leading video conferencing platforms.

No, the Mediator is there is facilitate discussions and assist the parties in reaching a resolution. A Mediator cannot compel any participant to do something.
